1. Introduction

These terms of use ("Terms") govern your use of the MeloGenAI plugin ("Plugin") created by Austin Coleman ("We", "Us", "Our"). This Plugin is designed for OpenAI's ChatGPT and for YouTube Music. The Plugin is an open-source project and its code can be accessed and contributed to on GitHub. By using this Plugin, you ("the user") are agreeing to these Terms. In addition, by using this API Client, you are agreeing to be bound by the OpenAI terms of use, OpenAI's ChatGPT Plugin terms and Google's YouTube Terms of Service.

2. Description of the Plugin

The Plugin is designed to generate playlists for the user on YouTube Music. The plugin requires a playlist title and a list of search queries and optionally a privacy setting that defaults to public. The plugin instructs the ChatGPT model to "Help the user generate a playlist for YouTube Music."

By installing and enabling this Plugin, the user agrees to allow the Plugin to generate playlists on their YouTube Music account. Note that since YouTube and YouTube Music use the same data, the playlists are also associated with your YouTube account. If you do not want the plugin to generate playlists on your account, you can uninstall the plugin or disable the plugin in ChatGPT. In addition to uninstalling, the user can also revoke the plugin's access to their account at their Google security settings page.

3. Your Responsibilities

You are solely responsible for the content of your playlists. You must ensure that any content you provide for playlist creation does not violate any laws, rules, or regulations, and does not infringe upon the rights of any third party. You represent and warrant that you have all necessary rights to use the content in the manner described by these Terms. You agree to be bound by the OpenAI terms of use and the YouTube Terms of Service.

4. Data and Privacy

By using the Plugin, you consent to the collection and use of your data as described in our privacy policy. You understand that your playlists will be made public by default and associated with your YouTube account. When interacting with the plugin, you can request it generate the playlist as public, private, or unlisted. Note that this plugin is designed to only generate new playlists. If you'd like to delete or modify the playlists this plugin generates, you can do that at the playlists page associated with the YouTube account you used to sign into the plugin.

5. Restrictions

You agree not to misuse the Plugin or help anyone else do so. You must not try to access the Plugin using a method other than the ChatGPT plugin interface and instructions provided by us.

6. Termination

You can stop using the Plugin at any time. Please note that your access to and use of the Plugin is also subject to the terms and conditions of the platforms the Plugin is used with, including OpenAI's ChatGPT and Google's YouTube Music.

7. Limitation of Liability

To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Plugin.

8. Governing Law

These Terms are governed by the laws of the State of California. Any dispute arising out of or in connection with these Terms or your use of the Plugin will be subject to the exclusive jurisdiction of the courts of California.

9. Intellectual Property

The Plugin, including its source code, documentation, appearance, structure, and organization, is owned by Austin Coleman and is protected by copyright and other intellectual property rights. The Plugin is licensed under the MIT license, available at https://github.com/AustinMichaelColeman/melo-gen-ai/blob/main/LICENSE. All rights not expressly granted in these Terms are reserved.

10. Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any disputes regarding the existence, validity or termination thereof, shall be settled by arbitration in accordance with the Arbitration Rules of the American Arbitration Association. The place of arbitration shall be in the State of California.

11. Indemnification

You agree to indemnify and hold harmless Austin Coleman and other MeloGenAI contributors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Plugin, or from your violation of these Terms.

12. Changes to the Terms

We may modify these Terms at any time. We will post the changes on this page. Your continued use of the Plugin after the changes constitutes your acceptance of the new Terms.

13. Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
